The Department of Justice and the Federal Trade Commission released their new Merger Guidelines in July 2023—the first major revision to the guidelines in 13 years. The new Guidelines reflect new enforcement approach and priorities, which will have far-reaching implications for merger reviews in the United States and abroad. At the American Bar Association Antitrust Section half-day conference “The New Merger Guidelines Workshop: Evolution or Revolution?” thought leaders, judges, and enforcers will discuss the implications of these changes for antitrust law, mergers and acquisitions, and global competition enforcement.
Partner Nicholas Hill will speak on the panel “Merger Litigation under the New Guidelines.” Panelists will discuss their expectations for how the new Merger Guidelines will influence litigation strategies and outcomes, including which changes will most directly challenge existing case law. Dr. Hill’s co-panelists include
- The Hon. Ana C. Reyes, US District Court for the District of Columbia
- Tara L. Reinhart, Skadden, Arps, Slate, Meagher & Flom LLP
- Dov Rothman, Analysis Group
