Partner Joseph Farrell received the Jerry S. Cohen Memorial Fund writing award in the category Best Antitrust Article of 2020 on Tacit Collusion. The article, “Oligopoly Coordination, Economic Analysis, and the Prophylactic Role of Horizontal Merger Enforcement,” co-authored with Jonathan B. Baker, was published in the University of Pennsylvania Law Review. Coordinated oligopoly outcomes occur when a firm’s conduct is substantially influenced by the prospect of rivals’ reactions. The authors recommend that merger policy be alert to the risks of coordinated effects and rely on a strengthened structural presumption in horizontal merger analysis to help control those risks.
