At the 2023 GCR Awards, the Department of Justice’s successful challenge of the Penguin Random House–Simon & Schuster merger—for which Partner Nicholas Hill was the DOJ’s expert—was recognized as the “Enforcement Action of the Year.” This award recognizes “the best decision or enforcement action from a competition authority or court in 2022.” Dr. Hill testified at the high-profile three-week bench trial that drew significant media attention and included testimony from famed author Stephen King. The UnitedHealth Group acquisition of Change Healthcare, which Bates White economists worked on, won the award for “Merger Control Matter of the Year–Americas.” This matter was also nominated in the category “Matter of the Year: Merger Control, Cartel, Unilateral Conduct, Litigation or Any Other Competition Matter Worldwide.”
Bates White experts worked on two additional mergers nominated for GCR’s “Merger Control Matter of the Year–Americas”: the U.S. Sugar–Imperial Sugar merger and the Rogers Communications–Shaw Communications merger. Finally, Nicholas Hill was one of six economists nominated for GCR’s Economist of the Year award.
