He has been retained as a consulting expert by multiple clients in pre-litigation settings to conduct economic and statistical analyses  and advise on next steps. Mr. Schwartz has experience supporting experts on behalf of both plaintiffs and defendants in various types of antitrust matters, including monopolization and cartel litigation and merger review. In addition to his antitrust work, Mr. Schwartz has significant experience in the insurance allocation arena. He provides support to clients and testifying and consulting experts through multiple phases of litigation, including discovery, expert report submission, deposition, and trial. He has worked on matters related to multiple industries, including technology, pharmaceuticals, industrials, energy, airlines, housing, and healthcare.

Selected Experience

  • Retained as consulting expert to provide economic and statistical analysis on behalf of a coalition of self-insured employers. Conducted analyses to address the client’s concerns surrounding potentially anticompetitive or fraudulent conduct by a healthcare provider system.
  • Retained as consulting expert to analyze labor-side antitrust issues surrounding a large healthcare provider network.
  • Provided Second Request compliance support to the merging parties in a proposed transaction in the industrials market.
  • On behalf of Highmark Health, supported the expert in providing testimony to the Pennsylvania Insurance Department (PID). Performed and presented economic analyses regarding modifications to certain conditions in the PID’s 2013 order.
  • Supported the expert on behalf of the consumer class in Klein et al. v. Meta. Assisted with the development of affirmative and rebuttal expert reports and prepared the expert to provide deposition testimony.
  • On behalf of the Department of Justice, supported the expert providing analysis of the likely competitive effects of a merger in the airline industry.
  • On behalf of the California Attorney General and federal plaintiffs in the California Gasoline Spot Market Antitrust Litigation, supported the experts in preparation of class certification report and a report estimating the extent to which the People of California were overcharged on the price of finished motor gasoline. 
  • Supported the expert analysis on behalf of merging parties of a proposed merger in the healthcare industry.
  • In In re Western States Wholesale Natural Gas Antitrust Litigation, supported the expert on behalf of energy trading companies alleged to have violated Section I of the Sherman Act. Examined the effect of any inaccuracies in the information provided to publishers on published indices.
