Sam Cohen

Sam Cohen is a Manager in the Life Sciences Practice. He specializes in supporting discovery efforts and conducting statistical and economic analyses using large, complex data sets, such as pharmaceutical sales and chargeback data as well as Medicaid and Medicare claims data. He has assisted counsel and testifying experts in all phases of litigation, including discovery, settlement, and deposition preparation. His work has focused on antitrust, class certification, and false claims issues in the life sciences sector, as well as antitrust issues in matters regarding mergers.

• Supported the expert in United States of America, ex rel. Michael Bawduniak v. Biogen IDEC Inc., a matter where the manufacturer allegedly violated the FCA through kickbacks in the form of honoraria, meals, and other event-related remuneration to physicians.
• Supported the expert in Becton, Dickinson & Co. v. Beckman Coulter, Inc. regarding regarding irreparable harm and nexus in connection with BD’s motion for a preliminary injunction to block Beckman from selling its CytoFLEX SRT line of cell sorters.
• Supported expert Ben Scher in Mier et al. v. CVS et al., Loughlin v. Vi-Jon, and Macormic et al. v. Vi-Jon in support of defendants’ opposition to class certification in three matters alleging deceptive labeling of hand sanitizer. 
• Assessed the value of pending and future asbestos-related personal injury claims on behalf of debtors in In re Bestwall, LLC.
• Supported experts in Himawan v. Cephalon, Inc. regarding the defendant’s commercially reasonable efforts to obtain FDA approval for the biologic Reslizumab in treating the condition eosinophilic esophagitis. 
• Supported expert in favor of the merger between Rogers Communications, Inc. and Shaw Communications, Inc. 

• Provided support in numerous confidential matters on behalf of companies in the healthcare industry, assessing alleged violations of the False Claims Act and alleged violations of the Anti-Kickback Statute.
