State of Wisconsin et al. v. Indivior Inc. f/k/a Reckitt Benckiser Pharmaceuticals Inc. et al.
In State of Wisconsin et al. v. Indivior Inc. f/k/a Reckitt Benckiser Pharmaceuticals Inc. et al., Eric Emch and academic affiliate Ernst Berndt submitted expert reports and provided deposition testimony on behalf of the plaintiff states, with Dr. Berndt also offering testimony on behalf of a class of direct purchasers. Plaintiffs allege that Indivior, formerly a part of Reckitt Benckiser, engaged in anticompetitive “product hop” behavior in order to move prescribing from its Suboxone Tablets product to its Suboxone Film line extension to maintain profits in anticipation of generic tablet competition. Dr. Berndt opined on economic issues associated with the product hop behavior, including disgorgement. Dr. Emch analyzed the relevant market and whether Reckitt’s alleged behavior harmed competition. No trial date has been set.
